Contract between the parties:

This document, through its content, makes available to third-party users the Regulation regarding the terms and conditions of use of the website www.skinseen.ro. The use of the site (including access, navigation and purchase of products on this site) constitutes an implicit agreement to comply with the terms and conditions stated in this document with all the effects and consequences arising from it.

The administrator of the website www.skinseen.ro reserves the right to modify the content of this agreement at any time, without prior notification to the people who use it, hereinafter referred to as Users. Users will have permanent access to the terms and conditions of use of the services, to be able to consult them at any time.

The right of consumers to unilaterally terminate the contract

Please make sure that you have checked the product specifications and its compatibility by visiting the manufacturer's page before buying it. The commercial relations between the buyer and www.skinseen.ro are officially regulated by Government Ordinance GEO 34/2014, regarding the rights of consumers in contracts concluded with professionals.

The consumer has the right to notify the merchant in writing that he is canceling the purchase, without penalties and without citing a reason, within 14 calendar days from receiving the product or, in the case of services, from concluding the contract.

The administrator of www.skinseen.ro makes permanent efforts to maintain the accuracy of the information on the site, but sometimes they may contain inaccuracies (the specifications or the price of the products modified by the manufacturer without notice or flawed by operating errors). Attention: the photos are informative and may contain accessories that are not included in the standard packages.

Fraud

In order to access and use certain sections of the website, it may be necessary to create a personal account. You hereby declare that you assume full responsibility for all and any of the activities carried out through the account you open on the website and, consequently, we advise you to ensure the security of the account password or other access data. If the security of the account you own is compromised, you must immediately notify the site administrator. W ww.skinseen.ro is not responsible for damages that are caused to you or that are caused to third parties of any kind, through the unauthorized use of the account.

Applicable law

By using the website www.skinseen.ro, the user agrees that the Romanian laws will govern the Terms and conditions of use and any dispute of any kind that may arise between users and www.skinseen.ro administrators or associations/ its partners/affiliates. In the event of any conflicts, an amicable solution will be tried first, and if an amicable solution is not possible, the conflict will be resolved by the competent court at the website administrator's headquarters, in accordance with the Romanian laws in force.

The website www.skinseen.ro together with the displayed information, the structure and the computer code of www.skinseen.ro including, but not limited to, brands, emblems, logos, design, menus, articles, texts, photographs, drawings etc. are the property of www.skinseen.ro and are protected by worldwide copyright, trademark and intellectual property laws.

The content or graphics of www.skinseen.ro cannot be reproduced/stored without prior written permission from the company that operates www.skinseen.ro.

Copyright infringement can be reported through the contact form or to the email address contact@skinseen.ro.

GUARANTEES

Our products do NOT benefit from a warranty, being consumable products.

We guarantee that the products sold by www.skinseen.ro are original products.

The guarantee of conformity is the guarantee offered by the seller, according to the legislation in force, and refers to a period of time between 6 months and 2 years by which the seller guarantees that the product sold is in accordance with the specifications that he undertook to sell. This guarantee is independent of the technical/commercial guarantee, which can be lower, higher or equal and is not subject to technical defects.

The time period established for repairing the repair is a maximum of 15 calendar days from the date on which the buyer informed the seller of the lack of conformity of the product.

Security of Personal Data

Skinseen.ro undertakes not to transmit the personal data of the website users to third parties, and to use them only for the purpose of establishing contact with its customers, as well as for the purpose of informing them about the aspects related to the operation of the website and its offers.

The personal data entered by the buyer will be used by skinseen.ro, only for the declared purpose of this site.

The information in the order form is necessary to send you the order confirmation, the delivery of the ordered products, the announcement of ongoing promotions, etc., in no case will they be provided to a third party.

Skinseen.ro does not sell, does not offer, does not exchange e-mail addresses obtained through this site, does not disclose your e-mail address to other people who access the pages of this site, without your explicit consent.

According to the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and regarding the free movement of such data, of Law no. 129/2018 and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector skinseen.ro has the obligation to administer in safe conditions and only for the specified purposes, the personal data that you provide us about you, a member of your family or another person. The purpose of data collection is: receipt, invoicing and delivery of online orders as well as the transmission of promotional materials, personalized messages, information on new products, newsletters, etc.. As an exception, your data will be transmitted to specialized courier companies in order to deliver the products ordered.

You are obliged to provide the data, which are necessary for invoicing and delivery. Your refusal causes the order not to be fulfilled.

The recorded information is intended for use by the operator.

According to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, benefiting from the right of access, intervention on the data, the right not to be subject to an individual decision and the right to go to court. At the same time, you have the right to object to the processing of personal data concerning you and to request the deletion of the data. You are also recognized as having the right to address yourself to justice.

If some of the data about you are incorrect, please inform us as soon as possible.

Any user who has explicitly provided his email address on the skinseen.ro website can opt for its deletion from our database. In each newsletter you have the option of unsubscribing.

Returning products

According to GEO no. 34/2014, the consumer has the right to withdraw from the distance contract, by notifying in writing, by e-mail, to the address contact@skinseen.ro that he renounces the purchase, without penalties and without invoking a reason, within 14 days calendar days from receiving the product. Renunciation of the purchase is applicable only to natural person customers (art. 2 paragraph 1).

The following are exempted from the right of withdrawal from the contract:

1. the supply of products that are likely to deteriorate or expire quickly (art. 16, letter d);

2. the supply of sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer (art. 16, letter e);

Thus, the returned cosmetic and hygiene products must be in the same condition in which they were delivered, in the original packaging (including the protective film or the seal, if any), with all related accessories, without showing signs of wear, modification or consumption , both in the case of products and accessories (boxes, additional packaging), with intact labels and all the original documents that accompanied them (eg: instructions for use).

The return of the products will be done at the customer's expense, without undue delay and within no more than 14 calendar days from the date on which he communicated to the professional his decision to withdraw from the contract in accordance with art. 11. The term is respected if the products are sent back by the consumer before the expiration of the period of 14 calendar days (art. 14, paragraph 1).

Upon receipt, the parcel will be checked to see if it meets the conditions mentioned above, otherwise it will be refused. Thus, parcels containing products in a different state than the one in which they were delivered, those whose return was not notified in advance, as well as those containing products damaged during transport as a result of improper packaging, will be refused.

According to the law, skinseen.ro will refund the value of the returned products (excluding transport charges) within 14 calendar days from the date of notification, by bank transfer, to the account specified by the customer for orders that had payment on delivery or by bank transfer and or for orders paid by card, the amount will be returned to the same card used for the transaction, within a maximum of 30 days from the acceptance of the return.

Delivery

We are not responsible for the delay in the delivery of orders caused by external factors: extreme weather conditions, road accidents, strikes, calamities, street demonstrations or other special situations that could prevent fast courier companies from delivering between 24 - 72 hours, a fact for which skinseen .ro will not pay compensation for damages caused by non-delivery of products on time.

The products will be delivered using Urgent Cargus services, the standard rate being 17 lei per parcel.

Delivery term

Orders will reach you in 48 working hours*. At the time of shipment, you will receive an automatic notification by e-mail.

*The 48-hour term is valid for products in stock at the time of order processing and is guaranteed only to the extent of the contractual obligations assumed by the courier company. The term runs from the moment of confirmation of dispatch of the order. For hard-to-reach localities, located outside the usual delivery area of ​​couriers, the delivery term can be extended in some cases by 24-48 hours. During promotions, the delivery term can be extended to 5-7 working days.

The transport is done by fast courier services and the transport charges and freebies are valid only in the coverage area of ​​the courier companies.

*For customers who make a return, the transport costs for returning the products will be borne by you.

How is the payment made?

• REMBURS (payment on delivery)

The total price of the package will be paid to the courier agent when you receive the products.

• OP (Payment Order)

After validating the order by phone or email, you can make the payment to the account that you receive by email when you have completed the order.

• Credit/Debit Card - online payment processor (www.plationline.ro)

a. Accepted cards are Mastercard / Maestro, Visa and Visa Electron - any model. The payment being made under maximum security conditions, without charging any additional commission.

b. After completing the order, you will be automatically redirected to a secure link where you will have to follow the instructions received. When you have completed the payment, both we and you receive a notification on your email address (the absence of this notification from Plati Online indicates that the transaction was not completed successfully).

c. Card data processing is done exclusively on the Plati Online server, www.skinseen.ro does not request or store any details related to your card.

d. Your transaction through the Plati Online system will appear on the account statement with the name "skinseen".

*For orders that do not exceed the amount of products of 50 lei, we reserve the right to request payment by bank transfer or online payment by card. (The return rate for these low value orders is high and hence this restriction)

Damage to parcels during transport

Despite the correct and rigorous packaging, to prevent incidents during the handling and delivery of parcels, situations may occur in which the integrity of the parcels is affected.

Prices

Our pricing policy assumes fair and stable long-term prices. All product prices on this site are expressed in RON, and include taxes. Prices do not include shipping charges. Shipping fees are calculated by the system and will be displayed at the end of the order. Additional weight fees for parcels exceeding 1 kg will be calculated after packing and weighing the parcels and will be communicated to customers in writing or by phone.

Promotions, price reductions

 

*The code received upon subscription can be used only once by the customer, for orders of at least 100 lei. The offer and reward points cannot be combined with other existing discounts or promotions on the website!

All the promotions present on the site are valid within the limit of the available stock or in precisely specified time intervals.

Service availability

The skinseen.ro administrator reserves the right to modify the structure and interface of any page or subpages of the www.skinseen.ro site at any time and at any free time interval chosen, having the right to interrupt temporarily or permanently, partially or in all the services made available to the public through this website without any prior individual or general notification.

Any dispute arising between Customers and skinseen.ro will be resolved amicably. In the event that it was not possible to resolve the conflict amicably, the jurisdiction rests with the courts at the site administrator's headquarters.

Final provisions

COSMETICS IMPORT SRL reserves the right to make any changes to these provisions, as well as any changes to the website www.skinseen.ro, its structure or any other changes that could affect the site, without any notification being necessary prior notice to users in this regard.

Electronic invoice

By reading the terms and conditions, you have agreed to issue the invoice related to the order exclusively in electronic format, which will be delivered to the e-mail address in the order or to your account.
